Legal value of translations for disputes

In Belgium, a document submitted before a court or an arbitral tribunal must be translated by a sworn translator-interpreter registered in the national register of judicial experts (Law of 10 April 2014). This requirement applies in particular to foreign insurance policies invoked in disputes, to expert assessments carried out abroad and to correspondence between international insurers.

The sworn translation bears the handwritten signature and stamp of the translator, as well as their SPF Justice registration number. It is directly admissible by Belgian civil, commercial and criminal courts, as well as by the Tariff Bureau, the Occupational Accident Fund (FAT) and the Financial Services and Markets Authority (FSMA).

Is a sworn translation required for a foreign insurance policy?

Yes, as soon as you wish to rely on that policy against a third party in Belgium - whether your own Belgian insurer, a judicial expert or a court. A non-certified translation (carried out by a non-sworn translator or an automatic tool) may be refused and render your file inadmissible. Only a translation bearing the signature and stamp of an expert registered with the Belgian SPF Justice is accepted without reservation.

Are my foreign insurance documents recognised in Belgium?

Foreign insurance documents are recognised in Belgium provided they are accompanied by a certified translation in French, Dutch or German depending on the relevant region. For policies issued in an EU Member State, no additional legalisation is in principle required.
